We are here to ensure that registered members provide appropriate care to all Ontarians.&nbsp;<\/p>\n\n\n\n<p>Anyone can file a complaint or report concerns about a Psychologist, Psychological Associate, or Behaviour Analyst. This includes a client, a family member or friend of the client, or a general member of the public.<br><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Before you make a complaint or report<\/strong><\/h3>\n\n\n\n<p>Please review the&nbsp;<a href=\"https:\/\/cpbao.ca\/fr\/ressources\/foire-aux-questions\/#cr-general\">Frequently Asked Questions<\/a>&nbsp;about complaints and reports. You may also contact the College at 416-961-8817\/1-800-489-8388 or&nbsp;<a href=\"mailto:invhear@cpbao.ca\" target=\"_blank\" rel=\"noreferrer noopener\">invhear@cpbao.ca<\/a>&nbsp;to discuss the complaints process.&nbsp;<\/p>\n\n\n\n<p>If you are comfortable doing so, you can first discuss your concerns with the Psychologist, Psychological Associate, or Behaviour Analyst. Sometimes, the member may be unaware of your concerns, and may be willing to resolve them with you in an appropriate manner.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The College may be able to assist with a resolution. Please see additional information regarding the College\u2019s <a href=\"https:\/\/cpbao.ca\/public\/complaints-reports-to-the-college\/facilitated-resolution-process-frp\/\">Facilitated Resolution Process<\/a>.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h4 class=\"wp-block-heading\">Regulations Related to Complaints and Reports<\/h4>\n\n\n\n<p>The College has expectations and rules that it expects members to follow. If a member doesn\u2019t follow the rules, they can face consequences. There are three main sources of rules for Psychologists,Psychological Associates, and Behaviour Analysts in Ontario. The purpose of these rules is to ensure that members are practising safely and in the public interest.<\/p>\n\n\n\n<p>The first is the <em><a rel=\"noreferrer noopener\" href=\"https:\/\/www.ontario.ca\/laws\/statute\/91r18\" target=\"_blank\">Regulated Health Professions Act, 1991<\/a><\/em>. This law applies to all regulated health professionals in Ontario. The <a rel=\"noreferrer noopener\" href=\"https:\/\/www.ontario.ca\/laws\/statute\/91r18#BK53\" target=\"_blank\">Health Professions Procedural Code<\/a> is part of the Act. The Code has a lot of information about how Colleges need to conduct their investigations.<\/p>\n\n\n\n<p>Second is the <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/21p27\" target=\"_blank\" rel=\"noreferrer noopener\"><em>51³Ô¹ÏºÚÁÏÍø and Applied Behaviour Analysis Act, 2021<\/em><\/a>. This Act applies to the practice of psychology and applied behaviour analysis in Ontario. The <a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/230195\" target=\"_blank\" rel=\"noreferrer noopener\">Professional Misconduct Regulation<\/a> is made under the authority of this Act. The Regulation lists conduct that would be considered professional misconduct.<\/p>\n\n\n\n<p>Third, College members are governed by the <a href=\"https:\/\/cpbao.ca\/fr\/membres\/exercice-professionnel-ressources\/normes-de-conduite-professionelle\/\">Standards of Professional Conduct, 2024<\/a>. The <em>Standards<\/em> are made under the authority of Code. The <em>Standards<\/em> set out rules that members are expected to follow in their practice of psychology or applied behaviour analysis. For our address information please click <a href=\"https:\/\/cpbao.ca\/fr\/contactez-nous\/\" data-type=\"page\" data-id=\"159\">here<\/a>.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-vertically-aligned-top is-layout-flow wp-block-column-is-layout-flow\">\n<h5 class=\"wp-block-heading\">Step 3:&nbsp;Submit your complaint with all relevant supporting documents.<\/h5>\n<\/div>\n<\/div>\n<\/div>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>WHAT HAPPENS AFTER I SUBMIT MY COMPLAINT?<\/strong><\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>The College will provide you with official acknowledgment of your complaint<\/strong>&nbsp;within 14 days. At the same time, the College will notify the member of the complaint. This means the member will receive a copy of your complaint, and copies of the supporting documents you provide.<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>The member will have an opportunity to respond to the complaint<\/strong>. In many cases, the College asks the member to provide a copy of the client&rsquo;s clinical record with their response. <br><\/li>\n\n\n\n<li><strong>The College will request additional information from the complainant, if necessary<\/strong>.<br><\/li>\n\n\n\n<li><strong>The College will give the member a copy of your additional information<\/strong>, along with any other information the College has collected.<br><\/li>\n\n\n\n<li><strong>A panel of the ICRC will consider the complaint.<\/strong>&nbsp;The ICRC uses its <strong><a href=\"https:\/\/cpbao.ca\/fr\/publique\/processus-disciplinaire\/cadre-devaluation-des-risques\/\">Risk Assessment Framework<\/a><\/strong> when considering outcomes for each case<br><\/li>\n\n\n\n<li><strong>Both you and the member will receive a copy of the ICRC&rsquo;s decision<\/strong>.&nbsp;&nbsp;<br><\/li>\n\n\n\n<li><strong>Both you and the member may ask for a review<\/strong>&nbsp;of the ICRC&rsquo;s decision to the Health Professions Appeal and Review Board.<\/li>\n<\/ol>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"making-a-report\">Making a Report<\/h3>\n\n\n\n<p>If you don\u2019t want to <a href=\"\/public\/complaints\/#making-a-complaint\">file a complaint<\/a>, and don\u2019t have a <a href=\"https:\/\/cpbao.ca\/fr\/membres\/exercice-professionnel-ressources\/prevention-et-traitement-des-abus-sexuels-et-violations-des-limites\/#mandatory-reporting\">mandatory reporting obligation<\/a>, you can still bring your concerns about a member to the College\u2019s attention.<\/p>\n\n\n\n<p>If you decide to make a report, the Registrar will review the information and decide how to proceed. There are important differences between a complaint and a report. As a reporter you would not be involved in the investigation. This means you won\u2019t get any additional information about the matter or a copy of any decision. There is no set time frame for investigating reports. Finally, there is no opportunity to seek a review of any decision before HPARB.<\/p>\n\n\n\n<div class=\"wp-block-cgroup-layout-blocks-cglp-callout-box is-style-cglb-callout-orange\">\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-vertically-aligned-top is-layout-flow wp-block-column-is-layout-flow\">\n<h5 class=\"wp-block-heading\">Step 1: Determine what kind of report you are making. <\/h5>\n\n\n\n<p>Do you need to make a <a href=\"https:\/\/cpbao.ca\/fr\/membres\/exercice-professionnel-ressources\/prevention-et-traitement-des-abus-sexuels-et-violations-des-limites\/#mandatory-reporting\">mandatory report<\/a>?<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h5 class=\"wp-block-heading\">Step 2: Use the link below.
