  {"id":15423,"date":"2024-01-31T15:32:00","date_gmt":"2024-01-31T19:32:00","guid":{"rendered":"https:\/\/cpbao.ca\/?p=15423"},"modified":"2024-01-31T16:37:44","modified_gmt":"2024-01-31T20:37:44","slug":"administrative-monetary-penalties-under-the-personal-health-information-protection-act","status":"publish","type":"post","link":"https:\/\/cpbao.ca\/fr\/administrative-monetary-penalties-under-the-personal-health-information-protection-act\/","title":{"rendered":"Administrative Monetary Penalties Under the Personal Health Information Protection Act"},"content":{"rendered":"\n<figure class=\"wp-block-table\"><table><tbody><tr><td>The Office of the Information and Privacy Commissioner of Ontario (IPC) is committed to protecting personal health information using a flexible and balanced approach that addresses privacy violations while encouraging accountability, learning, and continuous improvement. <br><br>As of <strong>January 1, 2024,<\/strong> the IPC has the discretion to issue administrative monetary penalties (AMPs) as part of its enforcement powers for violations of the <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/04p03\"><em>Personal Health Information Protection Act<\/em><\/a> (PHIPA). <br><br>Penalties are up to a maximum of $50,000 for individuals and $500,000 for organizations. AMPs may be issued for the purposes of encouraging compliance with PHIPA or preventing a person from deriving \u2014 directly or indirectly \u2014 any economic benefit from contravening the law. <br><br>AMPs are just one of the options in the IPC\u2019s regulatory toolkit for ensuring compliance with PHIPA. Breaches of PHIPA can be addressed in proportion to their severity, enhancing public trust in the health care system. <br><br><strong>A measured approach to enforcement<\/strong> <br><br>The IPC will not use AMPs as the default response to breaches. They will generally only be used as an enforcement option for more severe violations of PHIPA, not in cases involving unintentional errors or one-off mistakes. Our office recognizes that the majority of Ontarians working in the health care system are deeply committed to the protection of personal health information. When mistakes occur, there is almost always a genuine willingness to take responsibility and remedy errors. The IPC will take a measured approach in response to PHIPA violations, providing education, guidance, informal resolution, and recommendations when less severe violations occur. <br><br><strong>Guidance on criteria for AMPs<\/strong> <br><br>In cases where AMPs are determined to be an appropriate measure, the IPC will use the criteria set out in regulation under PHIPA to determine the amount. <br><br>Learn more about the criteria for AMPs and how the IPC will determine penalty amounts in our <a href=\"https:\/\/www.ipc.on.ca\/wp-content\/uploads\/2024\/01\/administrative-monetary-penalties_guidance-health-care-sector.pdf\">guidance<\/a>. <br><br>If you have additional questions about AMPs, email us at <a href=\"mailto:info@ipc.on.ca\">info@ipc.on.ca<\/a>.<\/td><\/tr><tr><td><strong>Les p\u00e9nalit\u00e9s administratives p\u00e9cuniaires en vertu de la Loi de 2004 sur la protection des renseignements sur la sant\u00e9<\/strong> <br><br>Le Bureau du commissaire \u00e0 l\u2019information et \u00e0 la protection de la vie priv\u00e9e de l\u2019Ontario (CIPVP) tient \u00e0 prot\u00e9ger les renseignements sur la sant\u00e9 selon une approche flexible et \u00e9quilibr\u00e9e consistant \u00e0 sanctionner les atteintes \u00e0 la vie priv\u00e9e tout en favorisant la reddition de comptes, l\u2019information et l\u2019am\u00e9lioration continue. <br><br>Depuis le <strong>1<sup>er<\/sup> janvier 2024,<\/strong> le CIPVP peut imposer des p\u00e9nalit\u00e9s administratives p\u00e9cuniaires (PAP), entre autres mesures, en cas de contravention \u00e0 la <a href=\"https:\/\/www.ontario.ca\/fr\/lois\/loi\/04p03\"><em>Loi de 2004 sur la protection des renseignements sur la sant\u00e9<\/em><\/a> (LPRPS). <br><br>Ces p\u00e9nalit\u00e9s peuvent atteindre au plus 50 000 $ pour les particuliers et 500 000 $ pour les organisations. Elles peuvent \u00eatre impos\u00e9es pour favoriser la conformit\u00e9 \u00e0 la LPRPS ou pour \u00e9viter qu\u2019une personne ne tire un b\u00e9n\u00e9fice p\u00e9cuniaire direct ou indirect d\u2019une contravention \u00e0 la loi. <br><br>Les PAP comptent parmi les diff\u00e9rents outils r\u00e9glementaires dont le CIPVP dispose afin d\u2019assurer la conformit\u00e9 \u00e0 la LPRPS. Les contraventions \u00e0 la LPRPS peuvent faire l\u2019objet de mesures correspondant \u00e0 leur gravit\u00e9, ce qui favorisera la confiance du public dans le syst\u00e8me de sant\u00e9. <br><br><strong>Application mesur\u00e9e de la loi<\/strong> <br><br>Le CIPVP n\u2019imposera pas syst\u00e9matiquement de PAP chaque fois qu\u2019il y a atteinte \u00e0 la vie priv\u00e9e; cette mesure sera r\u00e9serv\u00e9e g\u00e9n\u00e9ralement aux contraventions les plus graves \u00e0 la LPRPS, et ne sera pas employ\u00e9e pour sanctionner les erreurs involontaires ou ponctuelles. <br><br>Notre bureau reconna\u00eet que la plupart des Ontariennes et des Ontariens qui travaillent dans le syst\u00e8me de sant\u00e9 sont profond\u00e9ment attach\u00e9s \u00e0 la protection des renseignements personnels sur la sant\u00e9.
